Fans buy the 'wrong' Stephen King book

Does Marsha need to know about this do you think? Is she advertising her stuff under the guise of Stephen? (I didn't read the article..)

Nope. Just finds it funny (and profitable) that people are buying her book thinking they're getting Mr. King's Joyland. There's a guy selling his self pubbed books on Amazon under 'Stephen King' (presumably his name). Covers are similar in style to some of Mr. King's books--that's where it gets into very grey area for me. I wonder how much he's made off of mistaken assumptions? Scum.

In my opinion, that's very different.

This woman did not attempt to trick anyone. Her book was written first, so she didn't even try to "steal" by title.

I went to her tumbler page and read this.

I'm Emily Schultz. My first novel came out eight years ago. It was called Joyland. Last year Stephen King released a print-only novel with the same title. That was cool, until a few King readers bought the e-book version of my novel by mistake and started leaving negative and confused Amazon reviews. I asked Amazon to change their search results to keep people from buying the wrong book but never heard back. Apparently there were a lot of confused readers as this week I got a—for me—big royalty check for those mistaken books. I'm not so upset anymore. Sure, it's more a pleasant surprise than a fortune, and I'm stuck with those reviews, but I thought a blog detailing how we're spending the Stephen King money would be a nice way to end this funny and strange story.

She did try to get Amazon to correct it for purchasers. Now, she has some negative reviews and some money.

Edited to add: OMG! It's funny. Each purchase includes a picture, description and "Would Stephen King Like It".

It all comes down to buyer beware in my, ahem, book. The folks who purchased it obviously didn't read the description well enough to the point where it stated the author's name and date of publication. I don't think Marsha needs to waste her time with this one at all.

No Flake, she's not. Her book was written first, and happens to have the same title. People are downloading thinking it's King's. And even after reading it, some still think it is his.

I think what she's doing is funny. And since at least one review said it was Stephen's best work, I don't think she's stealing from anyone. Plus, they could get their money back if they quickly realized they bought the wrong book.
Imho she's stealing, just not technically and so she's probably not technically breaking the law. I suppose she could claim that she'd return money to those who mistook her book for sK's but she has no way of knowing who they are.

Well, i have actually got myself a new, very good, bedlamp now. Very bright and i can bend it in many positions so i can read in many places. So my flashlight days are over for this time. I found out that the one i had was more of an emergency thing. Not easy to handle when it comes to reading.

Have you seen the movie "October Sky" about a bunch of kids who want to build a rocket? They were in coal mining country and I saw a lot of these in the film - great for hands-free book reading!

So, do you think she should just assume all purchases of her book since the release of King's Joyland were an error and return all the money? Complete purchase or just her royalties?
Is it even possible for her to obtain the required information? How much time and effort should she put in to giving money back to people who didn't take the time to read the authors name? And she did try to get Amazon to fix it.

I'm glad he saw it. I thought her posts might make him laugh. I live his response. :)

To be honest: they bought the book SHE wrote and they read it. So the money is hers to keep. It's not her fault people don't check what they buy. Plus, price alone should have alarmed buyers: surely a debut from an unknown author is much cheaper than a new SK?
When I purchase a book online, I notice that the book description always gives the name of the author so I don't think she should give back the money. If anyone goes by the title alone, well that's their own fault for not reading further.

Yeah, maybe the blog is in bad taste, I don't think spending the money is. They bought her book, even if they didn't mean to, it's not like she misled anyone, and she got there first with the title. If people actually looked at the book they would have seen it didn't say Stephen king.

Buying the wrong book is forgivable, reading it, not realising it, and writing a review criticizing it for "not being king-like is not really forgivable.

Stephen kind of made a big deal of joyland being a printed copy only, most people should know.

There was a guy who sold a review of Joyland as a $1.99 eBook -- that's what generally came up at Amazon when you searched for Joyland. I think he was being exploitative, but it was still a case of buyer beware. However, Amazon's 1-click feature can entice people to buy before they think. I think she's having fun with this -- based on what she's buying, it doesn't seem like she made an exorbitant amount of money. The sum of the things she's listed so far is around $700.
